Terms and Conditions


 

1. Validity of Quote

All written quotes are valid for 14 calendar days from the date of issue. After this period, Pinecrest Construction reserves the right to revise pricing due to changes in labor, materials, or scheduling availability.

Quotes reflect the full scope of work based on the information provided at the time of quoting. Any changes to layout, design, materials, or site conditions must be discussed and confirmed in writing. Revisions to scope may result in adjusted pricing and/or schedule.

Each new quote issued supersedes all previous versions, including verbal discussions, text messages, sketches, and emails related to the same project.


2. Quote Revisions & Amendments

Clients are entitled to two versions of a quote, each with one complimentary revision. Additional revisions beyond this limit may be subject to administrative or administrative-time fees.

Clients are responsible for ensuring all project details, requirements, and assumptions are clearly communicated during the quoting stage.


3. Scope of Work

Only work explicitly listed in the approved quote will be completed. Any additional work must be requested in writing, approved in advance, and may result in additional cost and/or schedule changes.

Pinecrest Construction is not responsible for evaluating, correcting, or warranting work performed by others prior to our involvement.


4. Work Schedule & Delays

Pinecrest Construction is not liable for delays caused by factors beyond our control, including but not limited to:

 

  • Adverse weather
  • Material shortages or supplier delays
  • Permit or inspection delays
  • Restricted site access or unsafe conditions
  • Client-caused delays or indecision

Work may be paused, rescheduled, or re-sequenced to maintain safety, quality, and efficiency.


5. Site Access, Preparation & Conditions

 

Clients are responsible for providing clear, safe, and uninterrupted access to the work area during scheduled hours, and ensuring personal belongings, furniture, and landscaping items are removed or protected prior to arrival. If access is restricted, Pinecrest Construction reserves the right to pause work or apply additional charges.

Unforeseen/Hidden Site Conditions: Unforeseen conditions discovered during the course of work (including but not limited to: structural rot, insect damage, poor framing by previous contractors, faulty wiring, plumbing leaks, mold, or sub-surface bedrock during deck post excavation) are not included in the original quote. Correcting these defects requires a mandatory Change Order. The client is solely responsible for all additional labor and material costs required to bring hidden defects up to building code before original project work can resume.

 

6. PETS ON SITE 

Purpose

Construction environments involve tools, power equipment, dust, chemicals, debris, noise, and frequent movement. These conditions can pose serious safety and health risks to pets, occupants, and workers.

Pet Access & Containment

All pets must be fully secured in a separate room, crate, kennel, or outdoor enclosure away from all work areas before work begins and for the entire duration of the visit, including setup, active work, breaks, inspections, and cleanup.

Pets are not permitted to roam freely in or around work areas at any time. Pinecrest Construction personnel are not responsible for supervising, handling, restraining, calming, or interacting with pets.

Failure to secure pets may result in work delays, stoppage, rescheduling, or additional charges.


Aggressive or Unpredictable Pets

Pets displaying aggressive, territorial, protective, or unpredictable behavior are strictly prohibited from being present near the work area.

This includes, but is not limited to:

  • Growling, snapping, lunging, or biting
     
  • Charging at workers, tools, or equipment
     
  • Blocking access points or work zones
     
  • Any behavior that causes staff to feel unsafe
     

Pinecrest Construction reserves sole discretion to determine whether a pet’s behavior is unsafe.

If aggressive behavior is observed, work will stop immediately until the site is made safe. Continued refusal may result in rescheduling or job cancellation.


Disruptive Behavior

Disruptive behavior includes, but is not limited to:

  • Continuous or excessive barking, whining, or vocalization
     
  • Repeated attempts to approach, jump on, follow, or distract workers
     
  • Interfering with tools, materials, ladders, cords, or equipment
     

Disruptive behavior may result in work being paused until a safe and quiet working environment is restored. Excessive disruption may result in additional labor charges.


Health, Exposure & Liability

Pinecrest Construction accepts no responsibility or liability if a pet:

  • Ingests, inhales, swallows, chews, or otherwise comes into contact with any construction material, substance, dust, debris, tool, or chemical
     
  • Becomes sick, injured, poisoned, distressed, or shows signs of illness as a result of such exposure
     
  • Suffers short-term or long-term health effects related to site access or behavior
     

This includes, but is not limited to, paint, primers, sealants, adhesives, solvents, foams, dust, insulation, fasteners, debris, or packaging materials.

Pinecrest Construction is not responsible for veterinary costs, treatment, or related expenses.


Authority to Stop Work

Pinecrest Construction reserves the right to stop work immediately if pets create unsafe or disruptive conditions. Work will resume only once safety requirements are met.


7. Client Decisions, Availability & Delays

Timely client decisions are critical to maintaining schedule and efficiency.

Delays caused by:

  • Lack of approvals or confirmations
  • Limited availability or restricted work windows
  • Repeated interruptions
  • Changing instructions or indecision
     

may result in work being paused, rescheduled, or extended. Additional labor, return visits, or inefficiencies caused by such delays may result in additional charges.


8. Payment Terms

 

Unless otherwise stated in writing, the standard project payment structure is:


  • 50% Deposit upon written acceptance of the quote.
  • 25% Progress Payment at a designated project milestone.
  • 25% Final Payment upon substantial project completion.


Accepted Payment Methods: e-Transfer and Cheque are accepted at no additional cost. Visa and MasterCard payments are accepted but are subject to a 3% administrative processing fee added to the invoice total. Late payments are subject to 2% monthly interest compounded.



9. Cancellation Policy

 

Because project scheduling, custom material ordering, and structural planning require significant upfront administrative costs, the following cancellation policies apply:

Special Order Materials & Deposits: Once materials have been ordered or custom designs/drawings have commenced, the project deposit becomes 100% non-refundable, regardless of the project start date.

General Cancellations: If a project is canceled by the client prior to material ordering, the following administrative deductions apply to the deposit: 10% if canceled within 24 hours of signing; 25% if canceled more than 72 hours before the scheduled start date; and 50% if canceled within 72 hours of the scheduled start date.

No refunds or credits will be issued under any circumstances once physical on-site work begins.

10. Permits

Unless otherwise stated, the client is responsible for securing permits. Pinecrest Construction is not liable for consequences of unpermitted work requested by the client.


11. Promotional Discounts

  •  Any active promotions, including our New Customer Discount, are strictly subject to our standalone Promotional Terms and Conditions. This includes a strict $5,000 minimum project value threshold (before taxes) and a maximum savings cap of $1,500 CAD. Promotions must be explicitly requested and applied prior to contract signing, cannot be combined with other offers or insurance claims, and are limited to one per household.

12. PAINT COLOR CONFIRMATION & COLOR MATCHING

This policy applies specifically to situations where new paint is blended with or applied adjacent to existing painted surfaces.

The client is solely responsible for confirming and approving all paint color, tone, sheen, finish, brand, and product line prior to purchase or application.

If the client is unable to provide complete paint information, Pinecrest Construction will make every reasonable effort to achieve the closest possible color match using industry-standard methods and professional paint supplier guidance. Exact color matching cannot be guaranteed.


Color variation may occur due to:

  • Aging, fading, or sun exposure
  • Previous paint products or custom mixes
  • Sheen differences
  • Surface texture and porosity
  • Lighting conditions
     

Even with premium or ultra-premium paint products, slight visible differences may remain.

Once paint application is authorized, or once the paint supplier confirms the selected color represents the best achievable match, the result is deemed acceptable. Repainting for cosmetic preference alone, where no workmanship defect exists, is not included and may result in additional cost.


13. Materials & Finishes Disclaimer

Natural variation in materials is normal and not considered a defect. Pinecrest Construction is not responsible for material behavior over time, batch variation, or failures related to client-supplied products.

We reserve the right to refuse installation of unsafe or incompatible materials.


14. Cleanup & Disposal

Standard cleanup is included unless otherwise stated. Dump fees or bin rentals will be listed in the quote when applicable.


15. Photography & Promotion

Completed work may be photographed for portfolio and promotional use. Personal information will not be shared.


16. Workmanship Warranty

A 1-year limited workmanship warranty applies from completion date. This excludes normal wear, misuse, client-supplied materials, and manufacturer defects.


17. Acceptance of Terms

By accepting a quote, the client agrees to all Terms & Conditions above. Written, digital, or signed acceptance constitutes a legally binding agreement.
